These Terms & Conditions outline the rules, regulations, and operational responsibilities governing services provided by Core Civil Mining. By requesting quotes, engaging our contracting services, or navigating our website, you agree to comply with these terms.
Acceptance of Terms
By engaging Core Civil Mining ("we", "us", "our") for civil construction, earthworks, drainage, or mining services, you agree to be bound by these Terms & Conditions, along with any project-specific contracts, tenders, or supply agreements.
Quotations and Tenders
All prices and project estimates provided in our quotes remain valid for thirty (30) days from the date of issue, unless otherwise specified in writing. Quotes are based on details supplied by the client. We reserve the right to adjust costings if structural designs, site layouts, or material scopes change.
Client Access and Responsibilities
The client must ensure safe, unobstructed, and timely access to project sites. The client is responsible for obtaining all necessary municipal permits, engineering certifications, structural drawings, and environmental approvals prior to the commencement of active site works.
Safety and Environmental Compliance
Safety is our core commitment. All operations adhere strictly to WorkSafe WA, DMIRS, and EPA guidelines. Clients, subcontractors, and operators must comply with site safety rules and inductions. We reserve the right to suspend works immediately if we detect unsafe site conditions or environmental hazards.
Invoicing and Payment Terms
Invoices will be issued progressively based on completed project milestones, as agreed in the service contract. Unless otherwise specified in writing, payment is due within fourteen (14) days from the date of invoice. Late payments may accrue interest or cause project suspension.
Undisclosed Subsurface Conditions
Our cost estimates assume standard digging and soil profiles. We are not liable for additional costs, equipment wear, or timeline delays resulting from hidden underground hazards, unmapped utility lines, hard rock formations, or contaminated soil not disclosed in the project brief.
Subcontracting
To ensure specialized project delivery, Core Civil Mining reserves the right to delegate, coordinate, or subcontract specific components of the work scope (e.g., specialized engineering, logistics, crushing) to qualified third-party partners.
Warranties and Liability Period
We warrant that all contracting services are performed with professional care, skill, and in accordance with engineering standards. A standard Defects Liability Period applies as defined in your contract. This warranty does not cover issues arising from general wear, natural ground movement, or client-initiated changes.
Force Majeure
We are not liable for failures, suspensions, or delays in performance resulting from events beyond our control. This includes severe weather (floods, cyclones, bushfires), industrial action, material shortages, supply chain crises, pandemics, or government directives.
Limitation of Liability
To the maximum extent permitted by law, Core Civil Mining's liability is capped at the total amount paid by the client for the services in dispute. We are not liable for indirect or consequential losses, downtime costs, loss of business revenue, or reputational damage.
Intellectual Property
All conceptual drawings, engineering plans, survey data, project proposals, and pricing documentation prepared by us remain our intellectual property and cannot be copied, shared, or executed by third parties without our prior written consent.
Dispute Resolution
If a contractual dispute arises, both parties agree to engage in good-faith negotiations to resolve the matter. If unresolved, the parties agree to enter structured mediation before commencing any formal litigation.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of Western Australia. The client and Core Civil Mining submit to the exclusive jurisdiction of the courts of WA.
